Terms of Use
Last updated: March 23, 2026
These Terms of Use (“Terms”) govern your access to and use of Track Cut (the “App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
These Terms supplement Apple’s Licensed Application End User License Agreement (“Apple EULA”) for apps obtained from the App Store: Apple Standard EULA. If there is a conflict regarding App Store use, the Apple EULA controls to the extent required by law.
Our Privacy Policy explains how we handle information and is incorporated into these Terms.
1. Eligibility
You must comply with applicable laws when using the App. If you are under the age of majority in your jurisdiction, you may use the App only with permission and supervision of a parent or legal guardian.
2. License
Subject to these Terms and the Apple EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, for personal, non-commercial use unless we agree otherwise in writing.
You may not copy, modify, reverse engineer, decompile, or create derivative works of the App except where law expressly allows; remove proprietary notices; circumvent security or subscription controls; or use the App unlawfully.
3. App features
Track Cut provides photo and video editing tools, which may include:
- Filters, overlays, text, doodles, and timeline editing;
- Music and audio from in-app libraries;
- On-device AI-assisted tools such as video blur (face, background, object, manual), cutout-style effects, colorize, and upscale;
- Export and sharing of edited content; and
- Premium features available through subscription or in-app purchase.
We may add, change, or discontinue features at any time to improve the App, maintain security, or comply with law.
4. User content
You retain ownership of photos, videos, audio, and other material you import or create in the App (“User Content”). You are responsible for having the rights and permissions needed to use that material.
You grant us and our infrastructure providers only the limited rights necessary to operate the App (for example, processing you request on-device, or delivering catalog assets you choose to download). We do not claim ownership of your User Content.
5. On-device AI features
Local processing. Most AI-assisted editing in Track Cut—including blur, tracking, cutout effects, colorize, and upscale—runs on your device. That processing does not require uploading your media to our servers for those features.
Your responsibility. You are responsible for reviewing exported results and ensuring your use complies with applicable law and the rights of others.
No guarantee of results. AI-assisted outputs may vary in quality or accuracy. We do not warrant that results will meet every creative or technical expectation.
Acceptable use. You must not use AI or editing tools to create or distribute illegal, harmful, harassing, non-consensual, exploitative, or infringing content. We may restrict access to features if we reasonably believe these Terms or law have been violated.
6. Acceptable use
You agree not to:
- Violate laws or third-party rights;
- Upload malware or attempt to disrupt the App or its services;
- Scrape, spam, or abuse support or network resources;
- Misrepresent your identity or submit false information; or
- Use the App to produce or distribute content involving minors in a sexual or exploitative manner, or otherwise prohibited material.
7. Intellectual property
The App, including its software, design, trademarks, templates, and stock assets we provide, is owned by us or our licensors and protected by intellectual property laws. These Terms do not transfer ownership to you.
8. Subscriptions and purchases
Paid features are offered through Apple In-App Purchase. Apple handles billing and payment information. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period in your Apple Account settings.
Manage or cancel subscriptions in Settings → [your name] → Subscriptions. Refunds are handled by Apple under its policies. See also our Cancel Subscription page.
Prices and available plans may vary by region and may change where permitted by law.
9. Advertisements
Free versions of the App may display third-party ads. Ad content and linked sites are the responsibility of their providers. Where required, we will request consent before personalized advertising or tracking as described in the Privacy Policy.
10. Third-party services
The App may integrate analytics, advertising, crash reporting, cloud configuration, and content delivery services. Your use of those features may be subject to third-party terms and privacy policies.
11. Availability and updates
We may release updates, fixes, or changes that are required for security or compatibility. The App may be unavailable during maintenance or due to factors outside our reasonable control (including network or third-party outages).
12. Disclaimer of warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT AI-ASSISTED RESULTS WILL BE ACCURATE OR SUITABLE FOR EVERY PURPOSE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP OR SUBSCRIPTIONS IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ZERO IF YOU PAID NOTHING, EXCEPT WHERE LIABILITY CANNOT BE EXCLUDED BY LAW.
14. Termination
You may stop using the App by uninstalling it. We may suspend or terminate access if you breach these Terms, misuse the App, or where required by law or platform policies. Upon termination, the license granted to you ends.
15. Governing law
These Terms are governed by applicable laws of the jurisdiction in which the App operator is established, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
16. Changes
We may update these Terms from time to time. We will update the “Last updated” date when we do. Continued use after changes take effect constitutes acceptance. If you do not agree, stop using the App.
17. Apple-specific terms
These Terms are between you and the App provider, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support except as required by law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as permitted by the Apple EULA.
